TERMS AND CONDITIONS OF SERVICE AND PRODUCT USE DISCLAIMER

It’s requested that you please read the following terms with care. They explain how our relationship works, including the creation and delivery of your Human Design readings, and your participation in any other Programs of your choosing. When you purchase your Human Design reading from www.ClareZivanovic.com, you agree to these terms.

WHO WE ARE & WHAT WE OFFER

We are clarezivanovic.com, owned by Naturopath and Human Design Analyst, Clare Zivanovic (the “Site,” “Clare Zivanovic,” “We,” “Us,” “Our”). We provide human design and health-related content, services, products and programs that help you align with your highest potential, strengthen your mind-body connection, and support your own wellbeing.

WHAT YOU RECEIVE

When you purchase a Human Design Health Check, you receive all of the following:

15 minute, personalised Health Check audio recording delivered via email within 7 business days
A PDF showing your Human Design bodygraph
Recommendations of crystal and/or flower essences to support your healing
Knowledge that helps you understand why may have unconsciously created your symptoms, and how to start clearing them
Energetic wisdom that activates your highest healing potential
Awareness that helps you more deeply connect with your authentic self
Insights that could support your wellbeing for a lifetime.

When you purchase a Human Design Healthy Foundations reading, you receive all of the following:

75 minute, pre-recorded Human Design reading tailored to your needs delivered to your inbox within 14 business days
A PDF showing your Human Design bodygraph
Energetic health recommendations, e.g. crystals, flower essences, sound healing frequencies, etc.
Intuitive guidance from the nature and animal kingdoms
Soul-aligned insights that can support your wellbeing for a lifetime
Follow-up email connections from me to nurture you as you integrate this information.

WHAT YOU CAN EXPECT

You will receive your Health Check audio recording within 7 business days from your date of purchase.

You will receive your Healthy Foundations video within 14 business days from your date of purchase.

The interpretation of your Human Design included in your readings is solely that of Clare Zivanovic, and it makes no claim to align with Human Design “Source Material”, the teachings of Ra Uru Hu, or any other Human Design teacher or school.

You will be treated with kindness and respect by Our Team.

You may receive a follow up email within 7 days of your reading being delivered. You are welcome to ask an supportive questions that may assist your understanding of the delivered material at this time. Note that on-going, long term support is not offered with 1-off readings.

WHAT IS EXPECTED OF YOU

You are at least 18 years of age. If you are under 18 years of age, you have the permission of a parent or legal guardian to order a Human Design reading from Clare Zivanovic.

You will pay for all Human Design offerings, and for any other programs that you choose, before they are delivered.

You will be responsible for your own physical, mental and emotional wellbeing and your own results, at all times.

You will complete the Client Form promptly to ensure Clare Zivanovic can swiftly create your reading. You understand that your reading cannot be created until you have completed this step.

PAYMENT

Your payment is due before any Content is delivered, and it is non-refundable.

You may pay with credit card, or PayPal.

All fees are in Australian Dollars (AUD), and all payments must be made in AUD.

NO REFUNDS

Kindly note that we do not refund your payment for any service, product or program, for any reason. This includes if you decide not to use the service, product or program you purchased. This no refunds policy also applies if you decide you are unsatisfied with the Human Design reading provided by Clare Zivanovic.

We provide all the information you need to make an informed choice before you invest. Please take a moment before you invest to read all information carefully and make the best choice for you.

NON-DELIVERY

All content will be delivered to You either (1) by digital download to your computer or mobile device or (2) via access to a digital third-party hosted platform (“Delivery”).
If access to your Human Design reading is not delivered, it is your responsibility to inform Us by emailing hello@clarezivanovic.com. We will then make every reasonable effort to complete Delivery as soon as practicable, unless your device or operating system will not accept Delivery, in which case Delivery will be impossible.
You understand and agree that a delay in Delivery, or an inability to complete Delivery due to your device or operating system, shall not constitute a breach of these Terms of Service, and does not entitle you to cancellation of your purchase or compensation for any damages or inconvenience.

OUR INTELLECTUAL PROPERTY

All Content We provide to you, together with the processes and methodologies used to guide you in understanding the Content, with the exception of any references to work by others, is Our intellectual property (“Clare Zivanovic’s Intellectual Property”) and is protected by intellectual property law, including copyright and trademark law.

Our Limited License to You. We grant you a limited, non-exclusive, non-transferable license to use the Content for your personal use only.You may not, and you agree not to, use, copy, edit, publish, display, reproduce, distribute, or create derivative works of Clare Zivanovic’s Intellectual Property for any other purpose without the prior written consent of Clare ZIvanovic.

Limitations on Linking and Framing. You may establish a hypertext link to the Site so long as the link does not state or imply any sponsorship of your site by us or by the Site. However, you may not, without our prior written permission, frame or inline link any of the content of the Site or the Portal, or incorporate it or any of the Content or Clare Zivanovic’s Intellectual Property into another website.

Infringement & Irreparable Harm. You understand and agree that any violation of the terms of this paragraph: (1) is an infringement ofClare Zivanovic’s intellectual property rights, including but not limited to, her rights under federal copyright law; and (2) will cause Clare Zivanovic irreparable harm, for which she is entitled to immediate injunctive relief.

PERSONAL DATA & PRIVACY

Collection of Personal Data. We collect the following personal information for the preparation and Delivery of your Human Design reading: (1) your first and last name; (2) your email address; (3) your birth information (time, place, and location); (4) your current challenges and aims; and (5) your human design chart (together “Personal Information”). Our payment processor also collects your credit card information in order to process your payment.

Use of Personal Data. We will use your Personal Information only to: (1) create your Human Design reading; (2) deliver your Human Design reading; and (3) communicate with you, including sending you marketing emails. You have the option to unsubscribe from email communication from us at any time.

Accuracy of Personal Data. You are responsible for providing Us accurate Personal Information at the time you purchase your Human Design reading. If you provide Us incorrect Personal Information, we will not be obligated to resend, refund or reissue your Human Design reading.

Storage of Personal Data. We store your Personal Information in Google Drive and Mailchimp, for its use by Us in the manner stated above. We do not store your credit card information.

Unauthorized Disclosure. We will make all reasonable efforts to prevent unauthorized disclosure or exposure of your Personal Information, including:

maintain appropriate administrative, physical, and technical safeguards for protection of the security, confidentiality, and integrity of Personal Information; and
comply with all privacy and security laws that are applicable to data processors in the jurisdictions in which We do business.

Assumption of Risk. You recognize, understand and agree that sharing, hosting and storing data electronically involves the risk of unauthorized disclosure. When you purchase your Human Design reading from Clare Zivanovic, you agree to assume that risk with regard to your Personal Information.

Disclaimer. We use third party software applications with their own privacy policies for the collection and storage of your Personal Information and the processing of your payment. We make reasonable efforts to vet both security and privacy policies before choosing providers; however, We have no control over the effectiveness of the security measures of these applications. We do not represent, warranty or guarantee that your Personal Information will not be exposed or disclosed through errors or actions of third parties, including those with which we contract for products or services in order to deliver the Content.

NO REPRESENTATION OR GUARANTEE OF RESULTS

You understand, acknowledge and agree that Clare Zivanovic makes no representation or guarantee that you will achieve any results – physical, mental, emotional, psychological, spiritual, financial or otherwise, from the Content.

NOT MEDICAL ADVICE

You understand, acknowledge and agree that the Content provided by Clare Zivanovic during readings, on her website, on social media, or on any other platform is not to be used as medical, psychological or behavioral advice and/or treatment and is not a substitute for professional advice and/or treatment.

You agree that:

(1) you will not rely on the Content for medical, psychological or behavioral treatment, advice or healing;

(2) at all times, you are responsible for your own physical, mental, emotional, psychological, and spiritual wellbeing; and

(3) if you require medical and/or psychological care, you will retain the services of a practitioner that is not Clare Zivanovic.

NO WARRANTY

You understand and agree that your use of the Content supplied is solely at your own risk. The Content is provided “AS IS” and without any warranty of any kind. We do not warrant that the Content is free of any defects, errors, viruses or other harmful components, or that any defects or errors will be corrected, and we expressly disclaim all warranties, express or implied, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose.

LIMITATION OF LIABILITY

You understand and agree that We will not be liable, under any circumstances, on any legal or equitable theory of liability, for any direct, indirect, incidental, special or consequential damages, that result from the use of the Content, or the inability to use the Content.

You understand and agree that, the above notwithstanding, the amount of damages for which We will be liable to you, under any circumstances and any basis of liability, will not be greater than the amount you paid for the Content.

If your state does not allow the exclusion or limitation of certain types of damages, damages shall be limited to the extent allowed by the law of your state.

HOLD HARMLESS

You agree to defend, indemnify, and hold Us harmless and free of all liabilities, claims, and expenses, including attorney’s fees, that may arise out of your misuse of the Content, or from your violation of this Terms of Service.

ARBITRATION

Any dispute arising out of this Terms of Service shall be resolved by binding arbitration administered by the Queensland Law Society. By purchasing your Human Design reading, you consent to binding arbitration in Queensland.

CHOICE OF LAW

This Terms of Service, and any disputes or claims arising out of it, shall be governed by the laws of the state of Queensland, Australia, excluding its choice of law provisions.

SEVERABILITY

If any provision of these Terms of Services shall be found unlawful, void, or unenforceable, for any reason, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
